Union.<\/p>\n<p>According to a <a href=\"https:\/\/www.mpo.gov.cz\/assets\/en\/consumer-protection\/products-safety\/2024\/3\/Safety-Gate-2023-report.pdf\" rel=\"noopener noreferrer\">report published by Safety Gate<\/a>, the EU\u2019s system for rapid exchange of information on dangerous non-food products, the number of validated safety alerts was at an all-time high in 2023 since the system was established.<\/p>\n<p>Moreover, 31% of the alerts on Safety Gate come from dangerous products that were sold online.<\/p>\n<p>As a result, sellers on <a href=\"https:\/\/webinterpret.com\/en\/blog\/top-selling-items-amazon\" rel=\"noopener noreferrer\">Amazon<\/a>, <a href=\"https:\/\/webinterpret.com\/en\/blog\/top-selling-items-ebay\" rel=\"noopener noreferrer\">eBay<\/a>, and all other digital marketplaces will have to ensure their products are GPSR-compliant as EU lawmakers continue the push to make consumers safer.<\/p>\n<p>In this article, we\u2019ll cover the ins and outs of GPSR and examine what compliance with these regulations entails.<\/p>\n<div class=\"custom-box\">\n<h2>Key highlights of GPSR<\/h2>\n<ul>\n<li>Online sellers, manufacturers, and distributors must name an EU-responsible person.<\/li>\n<li>Under the GPSR, all products must be labeled with one or more <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_23_3190\" rel=\"noopener noreferrer\">General Product Safety Regulation<\/a> (GPSR) has been in force since June 12, 2023, and they will fully replace the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/ALL\/?uri=CELEX%3A32001L0095\" rel=\"noopener noreferrer\">General Product Safety Directive<\/a> (GPSD) on December 13, 2024.<\/p>\n<p data-pm-slice=\"1 1 []\">In addition, it complements the toy safety directive and replaces the<span data-color=\"var(--purple-10)\"> Food Imitating Product Directive<\/span> to increase the safety of the most vulnerable consumers in the European market.<\/p>\n<p>The block\u2019s new market surveillance network builds upon the existing regulations and tightens the safety measures for online sales.<\/p>\n<p>Its purpose is to increase the protection of vulnerable consumers, <span data-color=\"var(--purple-10)\">address safety concerns related to digital products<\/span>, and improve the market surveillance of dangerous goods sold online and offline.<\/p>\n<p data-pm-slice=\"1 1 []\">Consequently, sellers based inside and outside of the European Union will have to meet a new set of strict requirements when offering non-food products <span data-color=\"var(--purple-10)\">to retain market access or remove all non-compliant products from the market<\/span>.<\/p>\n<div class=\"testimonial-box\">\n<p>According to Article 22 of the General Product Safety Regulation :<\/p>\n<blockquote><p>\u2018Under the general safety requirement laid down in this Regulation, economic operators should be obliged to place only safe products on the market. Such a high level of safety should be primarily achieved through the design and the features of the product, taking into account the intended and foreseeable use and conditions of use of the product. We\u2019ll outline the most important differences between these documents to help you understand how the new regulations affect ecommerce.<\/p>\n<p>Most importantly, the General Product Safety Regulation is a set of regulations directly applicable to all EU member states and the European Economic Area (EEA). This definition considers several factors, such as the product\u2019s packaging, traits, effects on other products, specific consumer groups, and product presentation.<\/p>\n<p>\u00a0GSPR also offers a new definition of risk, indicating that risk is:<\/p>\n<blockquote>\n<p data-pm-slice=\"1 1 []\">\u2018a combination of the probability of an occurrence of a hazard causing harm and the degree of severity of that harm.\u2019<\/p>\n<\/blockquote>\n<p data-pm-slice=\"1 1 []\">The document takes cybersecurity and environmental risks into account and lists them among the parameters manufacturers must use when assessing product safety.<\/p>\n<p>Consequently, video game, AI, software, and app developers, as well as manufacturers of all other products that can cause addictive behavior or expose consumers to substantial cybersecurity threats, may have to revise their safety guidelines to comply with the GPSR.<\/p>\n<h2>What does GPSR mean for Amazon sellers?<\/h2>\n<p data-pm-slice=\"1 1 []\">Once the GPSR completely replaces the GPSD, the road to the EU market will become more complex. Online marketplace providers must check if sellers have an EURP and suspend stores or delete product listings without an authorized representative in the EU.<\/p>\n<p data-pm-slice=\"1 3 []\"><span data-color=\"var(--purple-10)\">An EU responsible person can be a: <\/span><\/p>\n<ul>\n<li><span data-color=\"var(--purple-10)\">A brand or product manufacturer established in the EU<\/span><\/li>\n<li><span data-color=\"var(--purple-10)\">A fulfilment service provider<\/span><\/li>\n<li><span data-color=\"var(--purple-10)\">An official product importer<\/span><\/li>\n<li><span data-color=\"var(--purple-10)\">European Authorised Representative (EAR) can assume the responsibilities of a responsible person, but only if they have a written mandate. <\/span><\/li>\n<\/ul>\n<p data-pm-slice=\"1 1 []\">A <span data-color=\"var(--purple-10)\">designated responsible person<\/span> serves as a brand\u2019s contact in the EU and represents a business in all matters related to product safety. This information must be on the product, packaging, or parcel and written in one of the EU\u2019s official languages.<\/p>\n<p>Moreover, sellers must <a href=\"https:\/\/webinterpret.com\/en\/blog\/ebay-listings-optimization-research\" rel=\"noopener noreferrer\">optimize listings<\/a> in accordance with GPSR.<\/p>\n<p>The product\u2019s picture, product identification and tracing information, and the manufacturer\u2019s and EURP\u2019s contact information must be featured in product listings on Amazon and other online marketplaces in the language most consumers in a marketplace understand.<\/p>\n<h3>Updating technical documentation and safety and warning information<\/h3>\n<p>All product listings must contain information about a product\u2019s potential safety issues and hazard risks. <a href=\"https:\/\/webinterpret.com\/en\/blog\/brand-registry-amazon\" rel=\"noopener noreferrer\">Sellers on Amazon<\/a> or similar marketplaces must upload manuals, test reports, technical documents, or pictures to product listings that outline the risks associated with a product.<\/p>\n<p>It\u2019s important to remember that safety information must be in the language of the market in which sellers are offering a product or new technologies.<\/p>\n<p>As a result, sellers must complete the product safety assessment prior to creating manuals and other technical documentation for EU online markets to ensure GPSR compliance.<\/p>\n<h2>Products excluded from GPSR<\/h2>\n<p>GPSR doesn\u2019t apply to all categories of products offered on online marketplaces. What is the General Product Safety Regulation(GPSR)? &nbsp; The General Product Safety Regulation (GPSR) has been in force since June 12, 2023, and they will fully replace the General Product Safety Directive (GPSD) on December 13, 2024. In addition, it complements the toy safety directive and replaces the Food Imitating Product Directive to increase the safety of the most vulnerable consumers in the European market. The block\u2019s new market surveillance network builds upon the existing regulations and tightens the safety measures for online sales. Its purpose is to increase the protection of vulnerable consumers, address safety concerns related to digital products, and improve the market surveillance of dangerous goods sold online and offline. Consequently, sellers based inside and outside of the European Union will have to meet a new set of strict requirements when offering non-food products to retain market access or remove all non-compliant products from the market. According to Article 22 of the General Product Safety Regulation : \u2018Under the general safety requirement laid down in this Regulation, economic operators should be obliged to place only safe products on the market. Such a high level of safety should be primarily achieved through the design and the features of the product, taking into account the intended and foreseeable use and conditions of use of the product. The remaining risks, if any, should be alleviated by means of certain safeguards, such as warnings and instructions.\u2019 Article 22 implies that Amazon sellers must revise and expand product listings to include: Product identification numbers. Additional information, such as pictures, that allows for easy product identification. Safety and warning documents, like test reports or product manuals, in the language of the market on which the item is sold. Moreover, all products listed on Amazon, eBay, and other marketplaces or the manufacturer\u2019s website must contain the following information: The manufacturer\u2019s or service provider&#8217;s name, registered trademark, or registered trade name. The manufacturer&#8217;s and the EU responsible person&#8217;s postal and electronic addresses consumers can use to contact the manufacturer. Differences between the General Product Safety Regulation and the General Product Safety Directive Although similar, the General Product Safety Regulation and the General Product Safety Directive (GPSD) have quite a few differences. We\u2019ll outline the most important differences between these documents to help you understand how the new regulations affect ecommerce. Most importantly, the General Product Safety Regulation is a set of regulations directly applicable to all EU member states and the European Economic Area (EEA). On the other hand, GPSD was only a directive that allowed each state to decide how to transpose it into national laws. The General Product Safety Regulation presents a more unified product safety network than the General Product Safety Directive, although member states can still introduce legislation to enforce the regulations. Unlike the GPSD, the GPSR explicitly states that its provisions apply to non-food products sold online or via other distance sales methods. The new regulations also apply to second-hand, reconditioned, or repaired products, but antiques and items advertised as \u2018repaired or reconditioned before use\u2019 are excluded from the GPSR. Another significant difference between the GPSD and GPSR is the risk assessment. Under the new regulations, a manufacturer or a service provider cannot place products on EU and EEA markets before conducting an internal risk assessment and using the findings to create technical documentation showing that a product is safe to use. Moreover, online marketplaces and manufacturers will be obligated to inform the customers and market surveillance authorities about safety warnings or product recalls. Understanding the GPSR definition of safe products GSPR keeps the definition of a safe product outlined in the GPSD: \u2018A product is considered safe if, under normal or reasonable, foreseeable conditions of use, it does not present any risk or only the minimum risk compatible with the product&#8217;s use.&#8217; Hence, safe products don\u2019t put the physical, mental, or social well-being of consumers at risk. This definition considers several factors, such as the product\u2019s packaging, traits, effects on other products, specific consumer groups, and product presentation. \u00a0GSPR also offers a new definition of risk, indicating that risk is: \u2018a combination of the probability of an occurrence of a hazard causing harm and the degree of severity of that harm.\u2019 The document takes cybersecurity and environmental risks into account and lists them among the parameters manufacturers must use when assessing product safety.
